United States Authentication Authorities

Q. Who are the U.S. "Competent Authorities" to issue the Apostille certificate?

A. There are three levels of U.S. competent authorities, one for Federal agencies, one for U.S. (federal) courts, and one for state documents, including documents executed before notaries.

1. Federal Executive and Administrative Agencies: Authentications Office, Department of State, 518 23rd St., N.W., Washington, D.C. 20520, (202) 647-5002 Fee: $5.00. For additional information, call the Federal Information Centre: 1-800-688-9889, and choose option 6 after you press 1 for touch tone phones. Walk-in service is available from the Authentications Office from 8 a.m. to 12 noon Monday-Friday, except holidays. Walk-in service is limited to 15 documents per person per day (documents can be multiple pages). Processing time for authentication requests sent by mail is 5 working days or less. 2. U.S. Courts: Clerks and Deputy Clerks of the Federal Court System. Fee: $5.00.

For the purposes of the Convention, clerks and deputy clerks of the U.S. Courts shall include the clerks and deputy clerks of the following: The Supreme Court of the United States, the Courts of Appeals for the First through the Eleventh Circuits and the District of Columbia Circuit, the United States District Courts, the United States Court of Claims, the United States Court of Customs and Patent Appeals, the United States Court of International Trade, the United States District Court for the District of the Canal Zone, the District Court of Guam, the District Court of the Virgin Islands, and the District Court for the Northern Mariana Islands.

Authentications Unit: The Authentications Unit may issue Apostilles or Certificates for the following types of documents:

Documents that have been notarized by a Texas Notary Public.You must submit the complete original document for authentication. For information regarding official certificates or apostilles for school records, please see FAQ #19. Recordable documents, such as birth certificates, may not be certified by a notary public. Request for Official Certificate or Apostille - NOT for use in proceedings relating to the adoption of one or more children - Form 2102.

Certified copies of recordable documents issued by a Texas statewide officer. This includes certified copies of birth/death certificates, vehicle title histories, etc.; documents issued by a county official including certified copies of marriage licenses, divorce decrees, probated wills, judgments, birth/death certificates, etc.; documents issued by a city or local registrar including certified copies of birth/death certificates. You must submit the complete document for authentication. Documents submitted for authentication must be recently issued certified copies. Request for Official Certificate or Apostille - NOT for use in proceedings relating to the adoption of one or more children - Form 2102.

Requests Relating to the Adoption of a Child: Requests for Apostilles or Certificates for use in proceedings related to the adoption of a child must be submitted using Form 2103. Request for Official Certificate or Apostille - Adoption Proceedings - for use in proceedings relating to the adoption of one or more children - Form 2103.

In addition to the above requirements, for all certifications or authentications you will also need to provide the following:

The name of the country where the document will be recorded.
The statutory fee of Fifteen Dollars ($15.00) per certificate or apostille unless the certificate or apostille is requested for use in adoption proceedings. * A check or money order drawn on a U.S. Bank and made payable to the Secretary of State of Texas must be submitted with the documents. American Express, Discover, MasterCard, and Visa cards are also accepted (subject to a 2.7% convenience fee).
A self-addressed, stamped envelope or pre-paid overnight airbill/envelope.
* If the Certificate/Apostille is requested for use in proceedings related to an adoption, the fee is $10.00 per Certificate/Apostille, and the total fees may not exceed $100.00 for the adoption of each child.

The Secretary of State does not translate documents.

Hours: 8:00 a.m. - 4:30 p.m. Monday - Friday (call for holiday hours)

Processing time is dependent on the number of Walk-In customers
and the number of documents being processed.

Mail-In Service

Please allow at least ten (10) business days for processing any request received by mail.

Our office does not offer expedited service for mail-in requests. The use of overnight mail service does not expedite processing time.
